RBCA Report Schedule Extension Requests Guide

The following provides guidance for RBCA site evaluation schedule extensions:

  • Our expectation is that Tier 1 evaluations will be conducted in 90 days and Tier 2 evaluations will be conducted in 180 days. The timing for the submittal of the report starts when the letter requiring the evaluation is received by the responsible party (RP). If during the Tier 1 evaluation phase of the project it is determined a Tier 2 evaluation is more appropriate, the certified groundwater professional assigned to the site or RP must inform the Department of Narural Resources (DNR), in writing, of changes in the report submittal schedule.

  • Schedule extension requests must be signed or cosigned by the RP. The request must provide a detailed reason for the request. The DNR will respond to the schedule request.

  • Except under very extreme situations, only one schedule extension request will be accepted for the site.

  • If additional schedule extensions are necessary, the certified groundwater professional may submit a letter signed or cosigned by the RP, explaining in detail the reason why the report cannot be submitted as scheduled and a revised submittal date for the report. DNR will use this information to evaluate whether to take legal or other actions. However, DNR will not provide a response to the letter. The letter will be made a part of the site file.

  • The following are examples of actions the DNR may take if the RBCA report is not submitted as scheduled in the DNR RBCA letter or the initial schedule extension request letter: Recommendation for legal action against the RP, disciplinary action taken against the certified groundwater professional or a request to the Fund to suspend the budget for the project.

  • DNR will now be granting schedule extensions past the Fund’s deadline of June 30, 2000. We will honor report submittal schedules specified in DNR letters that extend past the deadline. An example of this is the submittal schedule of a rejected report. The report must be submitted as scheduled in the letter. The DNR extension of the report due date past the June 30, 2000 deadline does not confirm the preservation of Fund benefits. The following discusses the process for retaining Fund benefits.

  • The Fund will be sending certified groundwater professionals informational material regarding the Fund’s deadline in the very near future. The mailing will consist of a Question & Answer Memo and a Time Extension Request for Fund Eligibility form. To preserve eligibility for Fund benefits, the form must be completed by the RP and the certified groundwater professional and submitted to both DNR and GAB Robins.
