New Inspection Program Requires Owner/Operator
Biennial Compliance Inspections
New rules require UST owners and operators to hire an Iowa certified
compliance inspector to inspect their UST systems for compliance with state
regulations. The new inspection program was developed as the result of a series
of meetings with representatives for petroleum marketers, the UST insurance
community, the environmental community and other stakeholders, with a common
objective of increasing compliance and preventing leaks from USTs. The DNR
initiated the meetings to discuss the best approach to meet program objectives
particularly in light of decreased funding for the UST program.
The first inspection under the compliance inspector program must be completed
by December 31, 2007, then every two years after that. For example, if a site is
inspected in April 2007 and passes inspection, the initial inspection
requirement is satisfied. That site doesn’t need another inspection until after
December 31, 2007, but sometime before December 31, 2009. An inspection cannot
take place sooner than six months after the last inspection.
If you are a tank owner/operator you are responsible for contacting the
temporarily certified compliance inspector to schedule an inspection and
complete it before December 31, 2007. A list of temporarily certified inspectors
will be provided on this website. You may schedule an inspection any time after November 14,
2006. Temporary certification is expected to extend to December 31, 2007 by
which time more permanent training and testing procedures for certification
should be in place.
To be certified as a compliance inspector, one must first be an Iowa licensed
installer or inspector. Iowa licensed installers/inspectors who want to be
certified as compliance inspectors must complete
two web-based EPA training
modules and pass the test; register for and complete DNR training; and submit a
certification fee of $150.
The DNR will audit a percentage of the inspections conducted by compliance
inspectors. Field personnel will still be available for work requests, emergency
response and follow up enforcement, tank closures, reported release
investigations and other duties.
